Bankruptcy Chapter 7
Chapter 7 is the type most people think about when the word bankruptcy comes to mind. The court appoints a trustee to oversee your case. You are allowed to keep your exempt property, and non-exempt property can be bought back or sold to distribute the money to creditors that file proper claims.
Bankruptcy Chapter 13
Chapter 13 requires debtors to make monthly payments to a chapter 13 trustee for a period of 36 to 60 months under a payment plan. The trustee then distributes that money to the debtor's creditors who have filed proper claims. Chapter 13 allows a debtor during the length of the plan to pay back past due amounts on houses, cars, and other loans that have collateral. One added benefit of Chapter 13 is that it allows debtors to protect property that is not exempt under the law.

Foreclosure Defense
